TESTIMONIAL SUBMISSION AGREEMENT

Please read this Agreement carefully before submitting your testimonial, photos, or videos ("Submission"). By submitting this form, you agree to all terms below.

1. Eligibility and Accuracy

By submitting this form, you represent and warrant that:

You are at least 18 years of age and a legal resident of the United States;
All information, stories, statements, photos, and videos included in your Submission are truthful, accurate, and either your own original content or content for which you hold all necessary rights and permissions; and
Any individual appearing in your submitted photos or videos has given you prior authorization to submit their image, likeness, voice, and/or name for the purposes described in this Agreement.

If your Submission includes a minor (any person under 18 years of age), you confirm that you are that minor's parent or legal guardian, or that you have obtained written consent from the minor's parent or legal guardian prior to submission.

2. License Grant

By submitting content, you grant LaFontaine Automotive Group and its affiliates, agencies, licensees, successors, and assigns a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, edit, adapt, publish, distribute, display, perform, broadcast, dub, subtitle, crop, retouch, create derivative works from, and otherwise exploit your Submission in whole or in part together with your name, city, likeness, image, voice, and biographical information, in any media now known or hereafter developed.

Permitted uses include, without limitation, advertising, marketing, social media, websites, streaming, television, radio, and other commercial purposes, without further notice, approval, or compensation to you, except where prohibited by applicable law.

As part of the license granted above, you specifically and expressly authorize LaFontaine Automotive Group and its affiliates, agencies, licensees, successors, and assigns to use your name, likeness, image, voice, photograph, biographical information, and any other identifying information included in or associated with your Submission in perpetuity, meaning for an unlimited duration, without expiration, for any advertising, marketing, promotional, or commercial purpose, in any format or medium, without any obligation to provide additional notice, seek additional consent, or pay any compensation, except where prohibited by applicable law.

This perpetual license survives the termination or expiration of any other agreement between you and LaFontaine Automotive Group.

3. No Guarantee of Use or Feature

Submission of a story, photo, or video does not guarantee that you or any member of your family will be featured in any commercial, advertisement, or other marketing material. All selection decisions, if any, will be made by LaFontaine Automotive Group in its sole discretion.

No purchase or payment of any kind is required to submit your story or to be considered for inclusion, and making a purchase will not improve your chances of selection.

4. Editing and Discretion

LaFontaine Automotive Group reserves the right to edit any Submission for length, clarity, style, legal compliance, or advertising suitability, and may decline to use any Submission for any reason without notice or obligation.

LaFontaine Automotive Group is under no obligation to return any submitted materials.

5. Submission Standards and Indemnification

You agree that your Submission will not contain any content that is unlawful, defamatory, obscene, harassing, misleading, or otherwise inappropriate, and will not infringe upon any third-party rights, including rights of copyright, trademark, privacy, publicity, or other proprietary interests.

You agree to defend, indemnify, and hold harmless LaFontaine Automotive Group and its affiliates, agents, employees, and representatives from and against any and all claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your Submission or any breach of the representations made in this Agreement.

6. Release of Claims

To the fullest extent permitted by applicable law, you release and discharge LaFontaine Automotive Group and its affiliates, agents, employees, and representatives from any and all claims arising from or related to the use of your Submission, including claims for invasion of privacy, appropriation of likeness, right of publicity, defamation, emotional distress, and copyright infringement.

7. Privacy

Any personal information collected through this form will be handled in accordance with the LaFontaine Automotive Group Privacy Policy, available at:

By submitting this form, you consent to LaFontaine Automotive Group using your personal information to administer this program, review your Submission, contact you regarding your Submission, and if selected coordinate production and related logistics.

By submitting this form, you consent to LaFontaine Automotive Group using your personal information to contact you about its products, services, promotions, offers, updates, and related marketing communications. These communications may be sent by email, telephone call, and text message. Your consent is not a condition to be considered for selection. You may opt out at any time by clicking the unsubscribe link in any marketing email, replying STOP to any text message, or by contacting LaFontaine Automotive Group directly.

8. No Compensation for Submission or Testimonial

You acknowledge and confirm that you are submitting your testimonial, story, photos, and/or videos voluntarily and without any payment, compensation, gift, discount, incentive, or other benefit of monetary value offered or provided by LaFontaine Automotive Group or any of its affiliates, agents, or representatives in exchange for your Submission. Your testimonial reflects your genuine, independent experience and opinion.

You further acknowledge that because no compensation or incentive of any kind has been offered or provided in exchange for your Submission, LaFontaine Automotive Group is under no obligation to identify your testimonial as a paid or sponsored endorsement in any advertising, marketing, or promotional material in which your Submission may appear.

If, at any time prior to or following your Submission, you receive or are offered any compensation, discount, gift, or other benefit in connection with your Submission, you agree to notify LaFontaine Automotive Group immediately in writing, as such a material connection may be subject to disclosure requirements under applicable law, including the Federal Trade Commission Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255).
